Section 1: Agreement

By accessing or using Drift Gallery ("Platform"), operated by Drift Gallery LLC ("Company," "we," "us"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Platform.

Section 2: Eligibility

You must be at least 18 years old to create an account or use the Platform. By creating an account, you represent and warrant that you are at least 18 years of age. We do not knowingly collect data from anyone under 18.

Section 3: Account Responsibilities

You are responsible for maintaining the security of your account credentials. You must notify us immediately at legal@driftgallery.io if you become aware of any unauthorized access to your account. You are responsible for all activity that occurs under your account. One account per person; multiple accounts are prohibited (see Section 14).

Section 4: Content Ownership & License

You retain all ownership rights to content you upload to the Platform. By uploading content, you grant Drift Gallery LLC a non-exclusive, worldwide, royalty-free license to display, distribute, and promote your content on and in connection with the Platform. This license terminates when you delete your content from the Platform, except for content that has been purchased by other users (which remains accessible to purchasers).

You represent and warrant that you have all necessary rights to upload, display, and monetize any content you submit. You indemnify Drift Gallery LLC against any claims arising from your content, including but not limited to copyright infringement, trademark infringement, and claims of unauthorized use.

Section 5: Prohibited Content

The following content is prohibited on the Platform and will be removed, with possible account termination:

Automatically blocked at upload:

Nudity (including artistic nudity)
Sexual content of any kind
Graphic violence and gore
Weapons as the primary subject
Child sexual abuse material (CSAM) — zero tolerance, immediate permanent ban

Removed if reported and confirmed:

Photorealistic depictions of real people without consent (deepfakes)
Hate speech, hate symbols, or content promoting discrimination
Spam or non-AI-generated content misrepresented as AI art
Unmodified copyrighted material
Content that violates applicable law
False tool compatibility claims — Recipes or Blueprints that deliberately misrepresent which AI tools they are compatible with or what results they produce

All image uploads (posts, avatars, Blueprint reference images, and Recipe example variation images) are automatically scanned by AI content moderation. Violations result in rejection. Repeat violations result in account termination per our Enforcement Escalation policy (Section 15).

Section 6: Acceptable Names Policy

Usernames and display names must not contain:

Profanity, slurs, or hate speech in any language
Sexual or violent terms
Impersonation of other users, public figures, brands, or AI tool companies
Trademarks or company names used in a misleading way
URLs, email addresses, or phone numbers
Terms implying official authority: "official," "verified," "admin," "staff," "moderator"

Violations require a name change within 7 days. Refusal results in account suspension.

Section 7: Comment and Text Content Rules

Comments, profile bios, Recipe text content, and Blueprint text content must not contain:

Hate speech, slurs, or discriminatory language
Harassment, threats, or personal attacks
Spam, repeated self-promotion, or link spam
Doxxing (sharing others' personal information without consent)
Sexually explicit language
Solicitation for services outside the Platform
Malicious URLs or phishing links
Instructions for generating prohibited content

Text content is moderated through user reports and admin review.

Section 8: Digital Products & Payments

Nature of Products: Recipes and Blueprints are digital products that are delivered instantly upon purchase. By purchasing any digital product on the Platform, you acknowledge and agree that: (a) You are purchasing access to instantly-delivered digital content; (b) The content is made available to you immediately upon completed payment; (c) AI-generated output is inherently variable — the same prompt or workflow may produce different results depending on the tool version, settings, hardware, random seed, and other factors beyond the creator's or Platform's control; (d) Variations in AI output quality or appearance are a characteristic of AI art tools, not a defect in the purchased product; (e) You have read and agree to the refund terms applicable to each product type as described in Section 11.

Platform Fees: Standard tier creators pay a 12% platform fee on all tips, Recipe sales, and Blueprint sales. Pro tier creators pay a 5% platform fee. Fees are calculated on the pre-Stripe-processing-fee amount.

Stripe: All payment processing is handled by Stripe. Drift Gallery LLC does not store credit card numbers or bank account details. By using payment features, you agree to Stripe's terms of service.

Tips: Minimum $2, maximum $500 per transaction. Tips are non-refundable except in cases of verified unauthorized transactions (see Section 11). New accounts are subject to tip velocity limits: a maximum of $50 in total tips sent within the first 48 hours of account creation.

Recipe Purchases: Recipes consist of prompt text and tool-specific instructions delivered immediately upon purchase. Because Recipe content is text-based and fully accessible upon delivery, Recipes are non-refundable except in cases of unauthorized transactions (see Section 11). Purchasing a Recipe grants a non-exclusive, non-transferable, personal-use license. Buyers may not resell, redistribute, or re-upload purchased Recipe content.

Blueprint Purchases: Blueprints may contain prompt text, generation settings, LoRA references, ComfyUI workflow files, creator notes, and reference images. Blueprints are subject to a 7-day refund window under limited circumstances (see Section 11). Purchasing a Blueprint grants a non-exclusive, non-transferable, personal-use license. Buyers may not resell, redistribute, or re-upload purchased Blueprint content.

Chargebacks: If a chargeback is filed against a transaction: (a) The disputed sale amount is debited from the creator's pending balance pending resolution; (b) Drift Gallery LLC absorbs the payment processor's chargeback fee — this fee is NOT passed to the creator; (c) We provide transaction evidence to Stripe to dispute fraudulent chargebacks on behalf of both the Platform and the creator; (d) If resolved in the creator's favor, the full sale amount is restored. Buyers who file chargebacks may have their accounts flagged for review or permanently terminated.

Subscriptions: Standard tier is $7/month. Pro tier is $15/month. Cancel anytime. No partial refunds for the current billing period. Upon cancellation, access continues through the end of the paid period, then reverts to the Free tier.

Complimentary Accounts: The Company may, at its sole discretion, grant complimentary Pro-tier access to select creators ("Lifetime Pro" or "Founding Artist" accounts). Such accounts receive the same features and are subject to the same terms as paid Pro accounts. Complimentary access may be revoked for violation of these Terms.

Section 9: Product Intellectual Property

Creators are responsible for ensuring that Recipes and Blueprints they sell do not contain stolen, plagiarized, or unauthorized material. Purchasing a Recipe or Blueprint grants the buyer a non-exclusive, non-transferable license for personal use only. Buyers may NOT:

Resell the product or any part of it
Redistribute the product to others
Re-upload the product or its contents to any platform
Claim the Recipe prompt or Blueprint workflow as their own creation
Use purchased prompt text to create competing marketplace listings on other platforms

Violation of these terms may result in account termination.

Section 10: DMCA

Drift Gallery LLC complies with the Digital Millennium Copyright Act. To file a DMCA takedown notice, send the following to legal@driftgallery.io:

Identification of the copyrighted work you claim has been infringed
The URL of the infringing content on the Platform
Your contact information (name, address, email, phone)
A statement that you have a good-faith belief that use of the material is not authorized
A statement under penalty of perjury that the information in the notice is accurate and that you are authorized to act on behalf of the copyright owner
Your physical or electronic signature

We will remove infringing content promptly upon receipt of a valid notice. The content creator will be notified and may submit a counter-notice within 10 business days per 17 U.S.C. § 512(g).

Repeat Infringer Policy: Three valid DMCA takedown notices against the same account within 12 months result in automatic permanent account termination. Counter-notices that result in content restoration do not count toward this total.

Section 11: Refund Policy

Tips: Non-refundable. The only exception is verified unauthorized transactions resulting from account compromise or stolen payment methods.

Recipes: Non-refundable. Because Recipe content is text-based and is fully delivered and accessible immediately upon purchase, all Recipe sales are final. The only exception is verified unauthorized transactions. If a Recipe is demonstrably defective (empty prompt text, no content delivered despite successful payment), contact legal@driftgallery.io.

Blueprints: Eligible for refund within 7 days of purchase for the following reasons only:

Broken or corrupted files that cannot be opened
Content materially different from the description
Empty or substantially incomplete Blueprint content
Verified unauthorized purchase (account compromise)

Not eligible for refund: subjective quality complaints, buyer's hardware/software limitations, change of mind, Blueprints delivered as described, variations in AI output.

AI Output Variability: AI-generated output is inherently variable. The same prompt or workflow may produce different results depending on the AI tool version, model weights, generation settings, hardware, and random seed values. This variability is a fundamental characteristic of AI art tools and is not a product defect.

To request a Blueprint refund, email legal@driftgallery.io with your purchase details and reason. We will respond within 5 business days. If approved, the refund is processed via Stripe and Blueprint access is revoked.

Excessive refund requests (3 or more within 90 days, across all product types) may result in suspension of purchasing privileges or account termination. Patterns of purchasing, accessing/copying content, and then requesting refunds or filing chargebacks constitute fraud and will result in permanent account termination.

Subscriptions: Non-refundable for the current billing period. Cancel anytime; access continues through the end of the paid period.

Section 12: Dispute Resolution Between Buyers and Creators

If a dispute arises between a buyer and a creator:

The parties should first attempt to resolve the dispute directly
If unresolved, either party may email legal@driftgallery.io with the transaction ID, description of the issue, and desired resolution
We will review and respond within 5 business days

Possible outcomes: refund issued (access revoked) for eligible Blueprint purchases, content removed, no action taken, or mediated resolution. Subjective quality complaints and inherent variation in AI output are not grounds for refund or dispute resolution. The Platform's decision is final for Platform-level actions.

Section 13: Arbitration & Class Action Waiver

Any disputes between you and Drift Gallery LLC that cannot be resolved informally will be resolved through binding individual arbitration administered by the American Arbitration Association (AAA) in the State of Georgia, USA.

CLASS ACTION WAIVER: You agree to resolve disputes on an individual basis only and waive any right to participate in a class action lawsuit or class-wide arbitration.

Section 14: Multi-Account Policy

Each person may have only one account on the Platform. The following activities are prohibited:

Creating multiple accounts for any purpose
Self-tipping or self-purchasing across accounts
Circumventing a ban by creating a new account
Inflating engagement metrics using alternate accounts

Detection methods include shared IP analysis, email pattern matching, linked Stripe accounts, and behavioral analysis. Violation results in termination of all associated accounts without appeal.

Section 15: Enforcement Escalation

First minor violation: Content removed, creator notified via email
Second violation or first serious violation: Content removed, formal written warning
Third violation or egregious first offense: Account suspension (temporary or permanent)
CSAM, credible threats, illegal content, ban circumvention: Immediate permanent ban, no warning, no appeal

Some enforcement actions are processed automatically by the Platform's systems, including violation counting, DMCA repeat infringer detection, chargeback threshold monitoring, and refund eligibility checking. Automated enforcement actions are logged and subject to the same appeal process described in Section 16.

Section 16: Appeal Process

Content rejection: Email legal@driftgallery.io. Response within 5 business days.
Content removal: Email legal@driftgallery.io. Response within 5 business days.
Account ban: Email legal@driftgallery.io with subject "Ban Appeal." Response within 10 business days.
Not eligible for appeal: Bans for CSAM, credible threats, repeat violations (3+), or ban circumvention.

Section 17: Liability

The Platform is provided "as is" without warranties of any kind. Drift Gallery LLC's total liability is limited to the greater of (a) the amount you paid to the Platform in the 12 months preceding the claim, or (b) $100 USD. In no event shall we be liable for any indirect, incidental, special, consequential, or punitive damages.

Section 18: General Provisions

Termination: We may suspend or terminate your account for violation of these Terms. You may delete your account at any time from Settings. When a creator deletes their account, unpurchased content is removed. Already-purchased Recipes and Blueprints remain accessible to buyers (displayed as "Deleted Artist").

Modifications: We may modify these Terms. Material changes will be communicated via email or prominent notice on the Platform. Continued use after notice constitutes acceptance.

Governing Law: These Terms are governed by the laws of the State of Georgia, USA.

Severability: If any provision is found unenforceable, the remaining provisions remain in effect.
